These Additional Terms apply when you access or use the Fitness Anny service through any television application, smart TV application, connected TV platform, streaming media device, set-top box, or similar device (the "TV App").
1. Access Through TV Devices
The Service may be made available through compatible smart TVs, connected TV devices, and third-party app distribution platforms. In order to use the TV App, you must have:
- (a) a compatible TV device or operating system;
- (b) an internet connection of sufficient quality to stream video content; and
- (c) an active Fitness Anny account and, where applicable, a valid payment method or active subscription.
You are responsible for all internet access charges, mobile or broadband charges, television provider fees, electricity costs, and other third-party fees associated with your access to and use of the TV App.
2. Device Compatibility and Availability
The availability of the TV App, as well as particular content, features, video quality, and technical functionality, may vary by device, operating system, territory, language, store platform, and internet connection. We do not guarantee that the TV App will be available on all devices or that all features available on mobile or web versions will also be available on TV devices.
3. Personal and Non-Commercial Use
The TV App is licensed, not sold, to you for your personal, private, and non-commercial use only. You may not use the TV App or any content made available through it for public performance, public display, commercial exhibition, group classes, gym screenings, hotel use, studio use, or any other business or revenue-generating purpose without our prior written consent.
4. Account Use and Access Restrictions
Your account is personal and may not be transferred, resold, shared, or made available to unauthorized third parties except as expressly permitted by applicable law or our subscription terms. We may set reasonable limits on the number of devices that may be logged in to the Service at the same time, including TV devices, in order to prevent abuse, unauthorized sharing, or circumvention of access controls.
5. Streaming Quality and Service Interruptions
The quality of your viewing experience through the TV App may be affected by a number of factors, including your location, available bandwidth, device capabilities, local network conditions, and the performance of your internet service provider. We may change, suspend, remove, or limit access to the TV App or any content at any time for maintenance, legal, licensing, business, or technical reasons.
6. Third-Party Platforms and App Stores
The TV App may be downloaded, installed, accessed, or distributed through third-party platforms, operating systems, device manufacturers, or app stores. Your use of the TV App must comply with any applicable terms, rules, and policies of those third parties. We are not responsible for third-party devices, operating systems, platforms, or services, or for any interruption, incompatibility, error, or restriction caused by them.
7. Apple-Specific Terms
If you access the TV App through an Apple-branded device or through Apple's tvOS/App Store ecosystem, you acknowledge and agree that:
- (a) these Terms are concluded solely between you and ANI FITNESS d.o.o., and not with Apple;
- (b) ANI FITNESS d.o.o., and not Apple, is solely responsible for the TV App and its content;
- (c) Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the TV App;
- (d) to the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the TV App;
- (e) ANI FITNESS d.o.o., and not Apple, is responsible for addressing any claims by you or any third party relating to the TV App, including product liability claims, legal or regulatory claims, consumer protection claims, privacy claims, and intellectual property infringement claims; and
- (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
8. Purchases, Billing and Refunds Through Third Parties
If you purchase a subscription, renewal, or any digital access through a third-party app store, platform operator, or device marketplace, your billing relationship may be governed in part by that third party's payment, cancellation, and refund rules. In such cases, you must manage your subscription, cancellation, and refund requests through the platform through which the purchase was made, unless applicable law requires otherwise.
9. Updates
We may from time to time release updates, patches, bug fixes, or upgrades for the TV App. Some updates may be installed automatically, while others may require action by you or may depend on the settings and capabilities of your device or app store account. Failure to install updates may affect the availability, security, or proper functioning of the TV App.
